Cancellation policy and weather conditions

What happens if you cancel, and what happens if the sea doesn't allow us to go out, based on objective safety criteria.

1. Cancellations by the customer

Cancellations made by the customer will be subject to the following conditions:

Notice periods will be calculated with reference to the scheduled start date and time of the booked service.

If the customer fails to show up on the booked date and time, this will be treated as a late cancellation and will not give rise to any refund.

2. Weather conditions and sea state

Unfavourable weather conditions do not, in themselves, constitute grounds for cancellation, nor do they automatically give rise to a right to a refund.

3. Wind strength criteria

Whether it is feasible to go out will be determined taking into account the wind strength and direction, the sea state, the wave height and direction, and the design category, power and particular characteristics of each boat. As a general rule:

Under no circumstances will a trip be authorised when conditions exceed the limits of the boat's design category or technical characteristics, or when there is a prohibition or restriction from the competent Maritime Authority.

A boat's design category sets its technical design limits and does not mean that all conditions within those limits are necessarily suitable for operating the boat as a rental.

4. Weather warnings

An AEMET weather warning will not automatically mean that the booking is cancelled.

We will check whether the phenomenon behind the warning actually affects the specific navigation area, the time slot of the booking and the wind and sea conditions forecast for the duration of the service.

Where there is a navigation prohibition or restriction from the Maritime Authority (Capitanía Marítima) or another competent authority that applies to the booked boat, area and time, the trip will not go ahead.

5. Criteria for deciding whether a trip can go ahead

To determine navigation conditions, we will take as reference the official AEMET marine forecasts for the area and time slot of the booking, together with the actual conditions at the time of departure and, where applicable, any warnings or instructions from the competent Maritime Authority.

The decision to go ahead with, delay, limit or suspend a trip will be made in accordance with the objective criteria set out in these conditions and will be based on maritime safety grounds.

The safety of people and the boat will always take precedence over carrying out the service.

6. Cancellation by the customer due to weather conditions

The customer's subjective perception of the weather conditions does not in itself constitute grounds for cancellation with a refund.

Clouds, lower temperatures than expected, light rain, wind, waves or other weather conditions that are within the established safety limits and allow the trip to be carried out safely do not entitle the customer to cancel the booking free of charge.

If, according to the objective criteria set out in these conditions, the trip can be carried out safely and the customer voluntarily decides not to use the boat, that decision will be treated as a cancellation by the customer, and the corresponding general cancellation policy will apply.

7. Cancellation for maritime safety reasons

When weather or sea conditions do not allow the activity to be carried out with an adequate level of safety according to the criteria set out above, or there is a prohibition or restriction from the competent authority, Barcos Marina del Este may cancel, delay or postpone the trip.

Where the trip is definitively cancelled by Barcos Marina del Este for weather or maritime safety reasons, the customer may choose between:

Under no circumstances will penalties be applied to the customer when Barcos Marina del Este determines, according to the objective criteria set out above, that the trip cannot be carried out safely.
